IHC Orders No Coercive Action Against Law-Abiding Sheesha Cafes

ISLAMABAD:The Islamabad High Court (IHC) has issued an order regarding sheesha cafes, directing authorities not to take coercive action against establishments operating legally under existing laws.

The high court has also sought a response from the federal government in a case concerning sheesha cafes and directed that rules governing their operation be implemented within one month.

The court ordered the federal cabinet to expedite approval of laws concerning a ban on sheesha smoking. It also directed the Islamabad Advocate General and Additional Attorney General to raise the matter before the relevant authorities.

The court observed that protecting the younger generation from drugs and sheesha smoking was the government’s responsibility. It expressed concern over the absence of a proper legal framework governing sheesha cafes.

The court directed the authorities to finalize the relevant rules within one month and submit a compliance report.

The Islamabad Police was ordered to continue strict action against illegal sheesha cafes, while the Anti-Narcotics Force was directed to cooperate with police in efforts to curb drug-related activities.

The court further ordered that no unlawful action should be taken against restaurants operating in accordance with the law. However, strict legal action should be taken in cases involving violations of the law or permit conditions.

The Islamabad High Court ordered that all related petitions be clubbed together and adjourned further proceedings until October 13.
