Pakistan Bar Council, SCBA Announce Support for Establishment of Federal Constitutional Court

ISLAMABAD — The Pakistan Bar Council (PBC) and the Supreme Court Bar Association (SCBA) have formally announced their support for the establishment of a Federal Constitutional Court, stating that the move will strengthen constitutional adjudication and ensure equal provincial representation.
In a joint declaration issued on Monday, both bodies condemned attempts by certain political groups to create divisions within the legal fraternity. The statement said that some “political elements” were issuing comments aimed at harming the democratic system, adding that the legal community strongly rejects statements made by “non-elected individuals.”
According to the joint communiqué, only statements released collectively by the PBC and SCBA represent the legal community on national issues; individual or minority opinions do not reflect the stance of the entire fraternity.
The councils asserted that the proposed amendment enabling the creation of a Federal Constitutional Court would allow equal provincial representation and improve the handling of constitutional and political matters. The new framework would also ensure timely listing and adjudication of public-interest cases before the Supreme Court.
The statement added that the legal community is closely monitoring all processes, including judicial appointments. If necessary, concerns will be conveyed through General House resolutions and decisions.
Reaffirming their longstanding position, the PBC and SCBA declared that they “stand firm for the independence of the judiciary, supremacy of law, and adherence to the Constitution.”
