Sindh High Court Orders Jobs Under Deceased Quota for Five Petitioners

KARACHI: A constitutional bench of the Sindh High Court has ordered authorities to provide employment to five petitioners under the deceased quota.
During the hearing of cases related to the deceased quota, the court ruled that the right granted under this quota cannot be withdrawn. It further stated that a Supreme Court judgment on such appointments would not apply retrospectively to past cases.
Counsel for the petitioners informed the court that the Departmental Recruitment Committee had already recommended their appointments.
The government lawyer argued that following the Supreme Court’s ruling on quota-based jobs, the petitioners’ appointments had been canceled and could no longer be granted.
However, the court held that the right to employment under the deceased quota arises immediately after the death of the employee, and the issuance of an appointment letter is merely an administrative formality.
The court directed the authorities to issue appointment letters to the petitioners within 15 days.
It is worth noting that the petitioners had approached the court seeking employment after the death of their parents.
