Lahore High Court to Hear Hassaan Niazi’s Petition Against Military Custody and Court Martial

Lahore: The Lahore High Court has scheduled a hearing on a petition filed by Hassaan Niazi challenging his transfer to military custody, the proceedings of the military court, and his court martial. A two-member bench comprising Justice Syed Shahbaz Rizvi and Justice Tariq Mehmood Bajwa will hear the case today at 12 PM.
The petition was filed through senior lawyer Faisal Siddiqi, representing Hassaan Niazi.
In his plea, Niazi contended that following his arrest in the May 9 case, he was not produced before a civilian court. Instead, Sarwar Road Police Station unlawfully handed him over to the military authorities despite existing court orders prohibiting such action.
The petition urges the court to declare the notification issued by the commanding officer on August 17, 2023 — under which Niazi was taken into military custody — as null and void. It also seeks to invalidate the entire proceedings of the military court and the court martial.
Niazi has requested the Lahore High Court to order his release from military custody and direct that he be either released from jail or presented before an Anti-Terrorism Court.
