Lahore High Court Grants Bail in Fake Currency Case, Rules Confession Inadmissible

LAHORE: The Lahore High Court has granted post-arrest bail to an accused in a fake currency case, ruling that his alleged confession was inadmissible.

Justice Amjad Pervaiz issued a four-page written judgment, stating that bail cannot be withheld as a form of punishment and that an accused must be presumed innocent until proven guilty.

According to the judgment, the court approved the accused’s post-arrest bail against surety bonds of Rs100,000 and one surety.

The court observed that there was no concrete evidence on record establishing that the accused had manufactured counterfeit currency or sold it in the market. Although the accused was arrested at a busy public place, no independent witness was associated with the proceedings.

The written judgment further noted that, apart from the recovery of counterfeit currency from the accused, there was no reliable evidence linking him to the manufacture or sale of fake notes. The prosecution also failed to present any evidence regarding a previous or potential buyer or customer.

The Lahore High Court clarified that these observations were made solely for deciding the bail application and would not affect the proceedings or findings of the trial court.
