Federal Constitutional Court Restores Inheritance Rights of Predeceased Daughter

Islamabad: The Federal Constitutional Court of Pakistan has restored the inheritance rights of a daughter who passed away before her father, ordering the redistribution of the estate of Abdullah Khan.
According to the court’s written order issued after the April 8 hearing, individuals cannot be deprived of inheritance rights merely on technical grounds. The court noted that in the present case, it is an established fact that the deceased Sardar Begum was the daughter of Chaudhry Abdullah Khan and Fatima Bibi.
The court also approved a request to include the children of Sardar Begum as parties in the case, thereby enabling them to claim their rightful share in the inheritance.
As per the case record, Sardar Begum died in 1957, while her father, Abdullah Khan, passed away in 1968. The distribution of the inheritance began in 1969 and was completed in 1989, but her heirs were not included in the process.
The court has directed that the inheritance be redistributed accordingly and has also sought assistance from the Additional Advocate General at the next hearing.
A two-member bench, headed by the Chief Justice, has adjourned further proceedings until May 13.
