Khyber Pakhtunkhwa CM Ali Amin Gandapur’s Warrants Not Suspended in I-9 Case

Islamabad: Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur failed to appear before the Anti-Terrorism Court today, and his arrest warrants could not be suspended.
According to reports, sources revealed that Ali Amin Gandapur was declared a proclaimed offender by the Anti-Terrorism Court in the I-9 case due to his repeated failure to appear in court. The court, presided over by Judge Tahir Abbas Supra, is currently hearing the trial of cases against Gandapur, including those related to the October 2022 protest.
On October 21, 2022, the Khyber Pakhtunkhwa CM had filed a petition seeking the suspension of his arrest warrants in the protest case, which was presented before Judge Tahir Abbas Supra of the Anti-Terrorism Court. His lawyer argued that they had approached the Peshawar High Court for relief in all cases, and the High Court had issued an order to stop the police from arresting him until further notice.
The petition requested that the arrest warrants be suspended until the decision of the Peshawar High Court’s writ petition. During the hearing, Judge Tahir Abbas Supra adjourned the matter, pending Ali Amin Gandapur’s appearance in court.
Gandapur’s lawyer, Raja Zahoor ul Hassan, stated that the Peshawar High Court had issued an injunction, preventing his client’s arrest until the next hearing. However, Judge Tahir Abbas Supra clarified that he had not issued any new arrest warrants for Gandapur. He said that any previous warrants had been issued before the High Court’s intervention, and the court had only directed the police to execute those warrants.
The Anti-Terrorism Court also stated that Gandapur remains a proclaimed offender, and therefore, his arrest warrants are non-bailable. Judge Supra emphasized that until Gandapur appears in court, the advertisement for his arrest cannot be canceled.
The court adjourned the hearing until July 10, 2025. Gandapur’s lawyer assured the court that the Khyber Pakhtunkhwa CM would appear on the next hearing. The judge reiterated that the accused must appear in court for any relief, as per Section 87 of the Criminal Procedure Code, and stated that the Peshawar High Court’s order prevented him from issuing any new orders regarding Gandapur’s arrest.
