Lashkari Raisani Serves Legal Notice to Balochistan Government Over Mines and Minerals Act 2025

Quetta:Senior politician and former Senator Nawabzada Haji Mir Lashkari Khan Raisani has issued a legal notice to the Department of Law and Parliamentary Affairs, Government of Balochistan, challenging the recently passed **Balochistan Mines and Minerals Act 2025**.

In a statement, senior legal counsel Muhammad Riaz Ahmed Advocate said that on behalf of his client, Lashkari Raisani, a formal legal notice has been sent to the provincial Secretary of Law and Parliamentary Affairs. The notice declares the Act to be **legally flawed, unconstitutional**, and passed **in undue haste** without meaningful debate, proper legislative scrutiny, or participation from elected representatives.

The notice also criticizes the **disregard of recommendations** submitted by the Mines and Minerals Association and the sidelining of the sub-committee formed to review the draft, which Raisani’s counsel claims constitutes a **violation of the democratic legislative process**.

According to the legal notice, implementing the Act without transparency or stakeholder consultation undermines constitutional safeguards. It invokes multiple articles of the Constitution of Pakistan:

* **Article 10-A**: Right to a fair process
* **Article 19-A**: Right to access information
* **Article 25**: Equality before the law
* **Articles 153 & 155**: Principles of provincial autonomy and resource control
* **Article 172(3)**: Provinces’ rights over natural resources

Raisani argues that these constitutional provisions were violated during the approval process and that the Act endangers Balochistan’s sovereignty over its natural resources.

The legal notice demands the **suspension of the Act’s enforcement** and calls for a **comprehensive and transparent review** of the legislation through consultations with industrial experts, civil society, affected local communities, and other relevant stakeholders.

The notice requests a formal response within **15 days**, warning that failure to do so will compel Raisani to initiate constitutional proceedings in the **Balochistan High Court** or the **Supreme Court of Pakistan** under **Article 199 or Article 184(3)** of the Constitution.
