Constitutional Bench Withdraws Ban on Converting Residential Plots into Commercial Use in Karachi

Islamabad:The Constitutional Bench of the Supreme Court of Pakistan has withdrawn its earlier decision that barred the conversion of residential plots into commercial properties in Karachi.
The court disposed of the long-running case related to illegal constructions in Karachi during a hearing held on Tuesday.
However, the bench clarified that the status of public spaces such as parks, hospitals, and playgrounds cannot be changed for commercial purposes.
During the proceedings, Justice Aamer Farooq stated that the court would not interfere in the functioning of institutions including the Sindh Building Control Authority. He observed that if any institution violates the law, affected parties should approach the relevant forum or the high court.
Justice Aamer Farooq further remarked that the power of suo motu notice no longer exists in its previous form and emphasized that laws already exist to deal with violations of building regulations. He expressed hope that town planning authorities would perform their duties in good faith.
The judge also stated that the Supreme Court’s decision regarding plot category conversion should not become an obstacle for institutions carrying out their legal responsibilities. “The court cannot make laws; it can only ensure their implementation,” he observed.
Meanwhile, Justice Arshad Hussain said that action would be taken against any official found violating the law.
