Lahore High Court Rules Husband Must Honor Separate Marriage Agreement in Addition to Dower

LAHORE: The Lahore High Court has ruled that a husband is legally bound to fulfill commitments made in a separate marriage agreement in addition to paying the dower (Haq Mehr) specified in the marriage contract.
In an 11-page judgment, Justice Muhammad Sajid Mahmood Sethi upheld a trial court’s decision requiring a husband to transfer a five-marla house to his wife, as promised in a separate agreement signed on the day of their marriage. The court dismissed the husband’s petition seeking to overturn the lower court’s ruling.
According to the judgment, the husband had independently agreed to provide the house to his wife, making the commitment legally enforceable. The court emphasized that Haq Mehr is a legal right of the wife and not a favor or discretionary gift from the husband.
The ruling further stated that under the law, dower is considered a debt owed by the husband to the wife. A woman’s failure to demand payment during the marriage does not amount to a waiver of her rights.
The court noted that many women refrain from claiming their dower due to social and domestic pressures, and such circumstances must be taken into account when resolving family disputes.
The judgment also observed that Haq Mehr may be determined verbally, in writing, or even after marriage, and that Islamic law permits a husband to increase the amount of dower after the marriage has taken place.
The court stressed that in family matters, judicial decisions should consider not only technical legal requirements but also the social realities that affect the parties involved.
