Advocate Mian Dawood Says Judges Cannot Personally Challenge Parliamentary Constitutional Amendments

Lahore (Qudrat News) — Advocate Mian Dawood stated that, at first glance, no judge of the High Court or even the Supreme Court can personally challenge a constitutional amendment passed by Parliament.
In a statement on X, he explained that any judge attempting to do so would be violating their oath, breaching Article 5 of the Constitution, and committing judicial misconduct. He added that the Supreme Judicial Council, acting on a citizen’s complaint or suo moto, can recommend the removal of such a judge under Article 209 of the Constitution.
Advocate Dawood further noted that, surprisingly, Justice Tariq Mahmood Jahangiri, who is facing a fake degree case, did not join the four esteemed fellow judges who filed a constitutional petition against the 27th Amendment in the Supreme Court. The petition was later withdrawn in accordance with the law. He suggested that Justice Jahangiri may be “filling a gap on his own accord.”
