Justice Ejaz Ishaq’s Letter on Use of Artificial Intelligence in Judiciary Surfaces

Islamabad: A letter written by Justice Sardar Ejaz Ishaq Khan regarding the use of artificial intelligence (AI) in the judiciary has come to light, in which he raised serious concerns over delegating judicial decision-making to machines.
The letter, addressed to Chief Justice Sarfraz Dogar, was also circulated among all judges. In it, Justice Ishaq emphasized that while the use of AI in judicial systems is being widely discussed around the world, its opponents argue that AI remains *programmable* and therefore cannot exercise genuine independence or moral judgment.
“Computers or robots cannot possess independent thought or the ability to form impartial opinions. Their decisions will always be bound by the codes and data programmed into them,” Justice Ishaq wrote.
He further noted that although he previously disagreed with this perspective, his stance changed after deliberations during the full court meeting. “I now align with those who oppose the use of artificial intelligence as a decision-maker within the judiciary,” the letter stated.
Justice Ishaq also expressed agreement with the dissenting opinions presented by **Justice Mohsin Akhtar Kayani** and **Justice Saman Rafat Imtiaz** during the full court discussion on the matter.
