Lahore High Court Rules Woman Entitled to Dower Even Without Rukhsati or Marital Relations

RAWALPINDI: The Rawalpindi Bench of the Lahore High Court has ruled that a woman remains entitled to receive her dower (Haq Mehr) even if rukhsati has not taken place or the marriage has not been consummated.

The court issued the ruling while deciding an appeal related to khula (judicial divorce initiated by a wife) and dower rights. The appeal filed by the woman was accepted, and the judgments of the lower courts were set aside.

According to the verdict, a wife’s entitlement to Haq Mehr is not dependent upon rukhsati or the establishment of marital relations. The court further held that if no specific time for payment of dower is mentioned in the marriage contract, the entire amount becomes immediately payable.

The judgment also stated that where the details of the dower are unclear or ambiguously recorded in the Nikahnama, the full amount must be paid upon demand.

The court emphasized that khula is an independent religious and legal right available to women. It held that a husband’s consent is not a prerequisite for the grant of khula and that a decree may be issued when reconciliation becomes impossible and the wife firmly decides to end the marriage.

The Rawalpindi Bench further ruled that once a khula decree becomes effective and the prescribed waiting period (iddat) is completed, a woman is legally permitted to remarry.

The case was brought before the Lahore High Court by a woman seeking relief regarding both her right to khula and the recovery of her dower.

The judgment is being viewed as an important clarification of women’s legal rights relating to marriage, divorce, and financial entitlements under Pakistani family law.
