Balochistan High Court Bars Deportation or Action Against Afghan Students Until Exams

**Islamabad (Qudrat Daily)** — The **Balochistan High Court** has issued a major ruling, **prohibiting the deportation or any punitive action against Afghan students** studying in Pakistan until the completion of their ongoing examinations. The directive came from a **division bench comprising Chief Justice Rozi Khan Bareech and Justice Sardar Ahmed Haleemi** during the hearing of a constitutional petition concerning the repatriation of Afghan refugees.

The court underscored that, under **Article 25(A)** of the **Constitution of Pakistan**, **education is a fundamental right** of every individual. It further instructed the administration to ensure that **no Afghan student is subjected to harassment or unnecessary pressure**.

During the hearing, **petitioner Advocate Syed Nazir Agha**, along with **Additional Attorney General Muhammad Farid Dogar**, **Malik Naseem Anwar Kasi**, and **Assistant Advocate General Zahoor Ahmed Baloch** represented the respective parties. The petitioner informed the court that **a large number of Afghan students** are currently enrolled in educational institutions across Balochistan, and any forced deportation at this stage could **waste their entire academic year** as final examinations are approaching.

Agha argued that the treatment of Afghan refugees is **violating their dignity and human rights**, urging the court to direct law enforcement agencies to act with **respect for human decency**. Taking these concerns seriously, the court ordered that **the administration must not interfere with the students’ education** and must **safeguard their right to study**.

The petition also contended that **Afghan nationals married to Pakistani citizens** are entitled to citizenship under the **Pakistan Citizenship Act, 1951**, and that **forced repatriation** violates **Articles 2A, 9, 25, and 25A** of the Constitution. The court **adjourned further proceedings** until the next scheduled hearing date.
