Islamabad: The Supreme Court has issued an order to military courts involved in the Swat trial case, directing them not to subject the accused to inhumane treatment. A seven-member larger bench headed by Justice Aminuddin Khan heard appeals regarding trials in military courts involving Swat.
Brigadier Imran, the focal person for meetings with the accused in military courts, appeared before the court. Lawyer Latif Khosa revealed that one accused was denied meetings with his family, resulting in the death of his five-year-old child. Justice Irfan Saadat remarked that the Attorney General cannot allow inhumane treatment of individuals.
Justice Muhammad Ali Mazhar questioned why weekly meetings with the accused’s families, as previously claimed, were not being continued. The Attorney General assured the court that from now on, one day a week would be allocated for such meetings. Justice Mazhar warned the Attorney General that any error in the final decision of appeals needs to be rectified by the court.
Justice Jamal Mandokhail issued an order that the accused should not be subjected to inhumane treatment and questioned why those whose physical remand has ended are still in jail. The Attorney General responded that judicial remand is not granted in military courts.
The Supreme Court’s directive aims to ensure fair treatment of accused individuals during the trial proceedings in military courts, emphasizing the importance of humane conduct throughout the legal process.
