Court Grants Relief to Rahat Fateh Ali Khan in Inheritance Property Dispute Case

Islamabad (Qudrat Daily) – Renowned singer Rahat Fateh Ali Khan has received significant relief from the court in an inheritance property dispute case.
According to details, a hearing was held at the Lahore High Court in a case related to an inheritance property dispute, during which the court set aside the trial court’s decision to dismiss Rahat Fateh Ali Khan’s appeal for not submitting court fees.
Justice Muhammad Sajid Mehmood Sethi issued an eight-page detailed verdict on the singer’s petition, restoring Rahat Fateh Ali Khan’s appeal and directing him to deposit a fine of Rs. 100,000.
The judgment stated that Rahat Fateh Ali Khan had filed a civil suit in Faisalabad regarding possession of a double-storey house measuring 1 kanal and 9 marla. The civil court had issued a decree against him on May 14, 2019.
It further noted that the singer later filed an appeal in the trial court against the civil court’s decision, but the appeal was dismissed on technical grounds for not submitting Rs. 15,000 in court fees.
Rahat Fateh Ali Khan then approached the Lahore High Court against this decision. The court observed that dismissing an appeal solely on the basis of non-payment of court fees is against the principles of justice.
The court remarked that appeals should not be rejected merely on technical grounds such as non-payment of fees, especially when the appellant is not given sufficient time. In this case, only four days were granted to submit the court fee, which the court considered inadequate.
The Lahore High Court emphasized that the right to appeal is a valuable legal right and should be decided on merit rather than technical deficiencies.
The court directed all parties, including Rahat Fateh Ali Khan, to appear before the relevant court on June 2 and instructed the trial court to decide the appeal on merit within two months without unnecessary delay.
