Federal Constitutional Court Sets Aside Supreme Court Verdict on Monal Restaurant Demolition

Islamabad:The Federal Constitutional Court has set aside the Supreme Court of Pakistan’s previous ruling ordering the demolition of **Monal Restaurant**, allowing appeals filed by the Capital Development Authority (CDA) and the Metropolitan Corporation while lifting the stay order in the case.

According to the court’s written judgment, the question of ownership of the restaurant and the land on which it stands will now be decided by the trial courts. The court directed that the trial courts must decide the matter independently and without being influenced by observations made in earlier judgments.

The ruling further stated that all administrative matters related to the property would be determined by the relevant regulatory authorities in accordance with the law.

During the hearing, Justice **Hasan Azhar Rizvi** criticized the earlier Supreme Court decision, observing that several important legal issues had not been adequately considered. He remarked that parts of the previous judgment included matters that were not part of the court proceedings.

When lawyer **Ahsan Bhoon** praised the Constitutional Court’s handling of the case, Justice Rizvi interrupted him, stating that the court would decide the matter strictly on legal merits rather than on appreciation from counsel.

The court also directed the trial courts to dispose of the pending cases as expeditiously as possible.
