Major Relief for Overseas Pakistanis: Separate Court System Established for Property Cases

Islamabad: A major facilitation measure has been introduced for overseas Pakistanis, as a separate judicial system has been established to handle property-related cases. Under the new arrangement, overseas Pakistanis will now be able to pursue legal cases in Pakistan without physically traveling to the country, using video-link hearings and e-filing systems.

According to the Bureau of Emigration and Overseas Employment, the “Protection of Overseas Pakistanis Property Act 2024” has been implemented to safeguard the property rights of Pakistanis living abroad. Under this law, special courts will be established across the country to expedite the resolution of property disputes and illegal possession cases.

The bureau stated in its official announcement that the new system aims to ensure full legal protection of overseas Pakistanis’ properties while providing them with a dedicated judicial mechanism to resolve their disputes efficiently.

The government said this initiative will help restore confidence among overseas Pakistanis and ensure the protection of their assets. It added that the special courts will exclusively hear cases related to the property of overseas citizens.

A special court has already started functioning in Islamabad, while the system is being gradually expanded to Punjab and other provinces. Under the new framework, overseas Pakistanis can file complaints and legal documents electronically, and can also attend court proceedings via video link without needing to travel to Pakistan.

Officials further stated that these courts have been given strict timelines for disposal of cases, with each case required to be decided within 90 days. In case of appeal, High Courts will also be bound to decide matters within the same timeframe.

Authorities believe the initiative will significantly reduce issues such as illegal occupation, property disputes, and fraud, while also boosting investor confidence and encouraging overseas investment in the country.
