Islamabad High Court Upholds Stay on Implementation of Recommendations for Reinstatement of Government Employees

Islamabad: The Islamabad High Court has upheld its decision to halt the implementation of recommendations made by the National Assembly’s Special Committee on Dismissed Employees regarding the reinstatement and regularization of government staff.

A division bench, comprising Justice Arbab Muhammad Tahir and Justice Inam Amin Minhas, dismissed intra-court appeals against a single bench ruling, terming the appeals without merit.

In its written judgment, the court stated that the Special Committee’s role was advisory and limited to presenting its report to the National Assembly. The court emphasized that the committee’s instructions to departmental heads regarding reinstatement, regularization, employee seniority, and salary determinations were beyond its legal and constitutional authority.

The court further observed that such actions cannot merely be labeled as irregularities but constitute a violation of the constitutional and legal framework, interfering with the powers of both the administration and judiciary.

Previously, the Special Committee, chaired by Qadir Khan Mandokhail, had issued instructions to regularize contract, daily wager, and project employees.
