PTI Challenges Governor’s Rule and Emergency in Peshawar High Court

PESHAWAR: Pakistan Tehreek-e-Insaf (PTI) has challenged the imposition of Governor’s Rule and an emergency in Khyber Pakhtunkhwa in the Peshawar High Court, seeking the restoration of the elected provincial government and an early hearing of the case.

According to details, an 86-page constitutional petition has been filed by Shah Faisal Ilyas, advocate, on behalf of PTI Chairman Barrister Gohar Ali Khan.

Speaking to the media after the petition was filed, Barrister Gohar said the imposition of Governor’s Rule and an emergency had resulted in the unconstitutional removal of an elected democratic government.

He expressed confidence that the high court would restore the provincial government and said PTI would continue its constitutional and political struggle against what it described as an illegal action.

The party has also requested the court to hear the matter as soon as possible, given its constitutional and political significance.

Salman Akram Raja Questions Constitutionality

Explaining the legal grounds of the petition, prominent lawyer and PTI leader Salman Akram Raja described the emergency and Governor’s Rule as unconstitutional and unlawful.

Raja referred to Article 232 of the Constitution of Pakistan, arguing that an emergency can be imposed in circumstances involving a serious internal disturbance that cannot be controlled by a provincial government. He maintained that, in the situation under consideration, the provincial assembly had not passed a resolution supporting such a measure.

He also questioned whether Pakistan had faced an invasion or attack by a foreign power that could justify the action. He demanded that the authorities clarify which country had allegedly launched an invasion if external aggression was being cited as a justification.

Raja further referred to Article 234 of the Constitution, which deals with a situation in which the constitutional machinery of a province fails. He argued that the provincial government in Khyber Pakhtunkhwa had not suffered such a breakdown and that the constitutional conditions for imposing Governor’s Rule had therefore not been met.

The petition seeks judicial scrutiny of the federal government’s actions, with PTI maintaining that the measures violate constitutional principles and undermine the democratic mandate of the province.

The case is expected to become a significant legal battleground amid escalating tensions between the federal government and PTI over security, provincial autonomy and the future of the Khyber Pakhtunkhwa government.
