Emergency Has No Fixed Duration, While Governor’s Rule Can Be Imposed for a Maximum of 6 Months: Justice (Retd) Shaiq Usmani

Islamabad (Qudrat Daily) — Legal expert Justice (Retd) Shaiq Usmani has said that emergency has no fixed duration, while governor’s rule can be imposed for a maximum of 6 months. As long as conditions do not improve, emergency will continue. Speaking on a Samaa News program, he said that the kind of situation prevailing in Khyber Pakhtunkhwa and Balochistan is such that emergency is needed, because if the situation continues in the direction it is heading, there could be further problems in the future. However, imposing governor’s rule or emergency in Balochistan and Khyber Pakhtunkhwa is not so easy.
He said that if emergency is imposed, then the President of the country gives approval, and a resolution must be passed by the assembly.
If a resolution is not passed in the provincial assembly, then within 10 days the resolution has to be presented before both houses. Governor’s rule can be imposed for 2 months and extended for 6 months, while emergency has no fixed duration — as long as conditions do not improve, emergency will continue.
On the occasion, PTI Khyber Pakhtunkhwa President Junaid Akbar, speaking on the Samaa News program, said that government in Khyber Pakhtunkhwa is not their compulsion; rather, it will become easier for them. “When workers tell us that no transfer or posting happens, then protesting will become easier for us. It will become easier for us — many things we want to do but cannot due to the compulsions of the provincial government — then protesting will become easier for us,” he said.
He said that Imran Khan also toppled his own governments. “The issue of losing power can be a problem for them because these people earn from power; their kitchen runs on it. If the federal government imposes governor’s rule or emergency, the public will react strongly. We did not get the Khyber Pakhtunkhwa government at anyone’s wish. The federal government does not even have the courage to topple the PTI government; if they had the courage, they would not have let Sohail Afridi become chief minister at all,” he said.
