Balochistan High Court Orders Immediate Processing of Pending Lawyer Enrolment Cases

QUETTA – The Balochistan High Court’s Larger Bench has issued a landmark ruling directing the Balochistan Bar Council to immediately present all pending enrolment cases of eligible lawyers before the court’s Enrolment Committee, ensuring timely processing of applications for advocates seeking to obtain their practising licences.

The order was passed on August 3, 2026, in Civil Petition No. 471 of 2026 (Mir Attaullah, Member Balochistan Bar Council vs. Chairman Balochistan Bar Council and others), addressing long-standing delays in the enrolment and licensing process for legal practitioners.

Clear Directive to Bar Council

The Larger Bench instructed the Secretary of the Balochistan Bar Council to expedite the submission of all cases involving apprentices/advocates awaiting interviews, ensuring that eligible applicants can benefit from their right to enrolment and practising licences under the law without unnecessary delays.

The court directed that all pending cases, where concerned apprentices/advocates are waiting for interviews, must be processed and submitted before the High Court’s Enrolment Committee for further action in accordance with the law.

Retroactive Entitlement from Eligibility Date

In a significant clarification, the court ruled that candidates who succeed in the scheduled interviews shall be considered entitled to their licences from the date of their eligibility/qualification, rather than merely from the date of the interview.

This means that the right to a licence will be recognized from the date on which the candidate legally became eligible, not from the later date when the interview was actually conducted – a ruling designed to protect the legal rights of deserving candidates whose cases have faced administrative delays.

Aim to Eliminate Unnecessary Delays

The High Court’s ruling aims to address the backlog of pending enrolment matters, safeguard the statutory rights of eligible candidates, and eliminate unnecessary delays in the enrolment and practising licence process.

The court observed that timely resolution of enrolment applications is essential for aspiring advocates to practice law without undue hindrance, and directed the Bar Council to ensure compliance with the order.

Bar Council Secretary Expected to Act Promptly

In light of the judicial order, the Secretary of the Balochistan Bar Council is expected to complete all necessary measures to present the pending cases before the Enrolment Committee without further delay, so that the enrolment process for eligible applicants can be finalized in accordance with the law and the court’s directives.
