US Federal Judge Temporarily Blocks Trump’s Executive Order on Birthright Citizenship

Washington:A U.S. federal judge has declared President Donald Trump’s executive order redefining birthright citizenship unconstitutional, temporarily suspending it. On Thursday, the judge’s ruling prevented the Trump administration from taking any action to enforce the order for 14 days.*

During this period, both parties will present further arguments regarding the validity of the president’s executive order on birthright citizenship. The judge has scheduled a hearing for February 6 to determine whether the case should be delayed for a longer period while proceedings continue.

Several states, including Arizona, Illinois, Oregon, and Washington, had sought a temporary restraining order to block the executive order in court. The case is part of a broader legal challenge that includes five lawsuits filed by 22 states and immigrant rights groups, including personal testimonies from attorneys general who themselves are U.S. citizens by birth.

The plaintiffs argue that the 14th Amendment of the U.S. Constitution guarantees citizenship to those born on U.S. soil, and that American states have interpreted this amendment in the same way for over a century.

In contrast, the U.S. Department of Justice stated that it would vigorously defend the president’s executive order, claiming that it properly interprets the 14th Amendment.

The 14th Amendment, ratified in 1868, grants citizenship to children born on U.S. soil, a measure originally intended to secure citizenship for former slaves after the Civil War.

It’s important to note that President Trump issued an executive order on Thursday stating that children born after February 19 to parents who are in the U.S. illegally would not be granted American citizenship.
