Islamabad: The Supreme Court has delivered its verdict on the Mubarak Shahani case, partially accepting the review petitions.
Justice Na’eem Akhtar Afghan, part of the three-member bench of the apex court, announced the reserved judgment in Mubarak Ahmed Shahani’s bail case. The court has partially accepted the review petitions.
Subsequently, the written decision of the Supreme Court regarding the Mubarak Shahani case has been issued, stating that religious freedom is subject to fundamental constitutional rights, public order, and morality. The review petition by the Punjab government has been accepted.
In its written decision, the court emphasized that belief in the finality and unqualified belief in the prophethood is a fundamental belief of Islam. It reiterated that Pakistan’s constitution also defines belief in the finality of prophethood as an essential criterion for being Muslim. The decisions of Majib ur Rahman and Zahid-ud-Din’s cases concerning those who identify as Ahmadis were also referenced.
The court maintained consistency with its earlier orders from February 6, 2024, regarding these precedents.
