Islamabad: The Supreme Court of Pakistan has issued a written order on the direction of Chief Justice Lahore High Court to resolve the matter of Election Tribunals. A 5-member larger bench under the leadership of Chief Justice Pakistan Justice Qazi Faez Isa issued the order.
The Supreme Court’s 3-page written order of the last hearing states that Lahore High Court’s decision of May 29 and Election Commission’s notification of June 12 are suspended until the next hearing.
According to the written order, the next hearing will take place after a meeting between the Election Commission and Chief Justice Lahore High Court. The meeting will be held at Lahore High Court after the oath-taking of the new Chief Justice.
In compliance with the Supreme Court’s written order, the Election Commission wrote letters to the registrars of 4 High Courts on February 14, while a letter was written to the registrar of Lahore High Court on February 15.
The written order states that the registrar of Lahore High Court responded to the letter regarding the names of 2 judges of Lahore High Court, and the Election Commission issued the notification for 2 judges on the same day, including the jurisdictional area in writing.
The written order of the Supreme Court states that the 2 judges were insufficient, and the Election Commission requested additional judges for the formation of Election Tribunals. The Supreme Court has directed that the Election Commission and Chief Justice Lahore High Court should meet and resolve the issue.
The written order of the Supreme Court directs that both the Election Commission and Chief Justice Lahore High Court are constitutional bodies deserving utmost respect, and consultation between these constitutional bodies can resolve the matter. The Attorney General also agreed that meaningful consultation should take place.
The court’s written order states that the court was informed that Chief Justice Lahore High Court was nominated unanimously in the Judicial Commission meeting on July 2. Without going into the merits of the case, the court is keeping the case under suspension pending meaningful consultation between Chief Justice Lahore High Court and the Election Commission.
The Supreme Court’s written order mentions that the Election Commission’s letter of April 26, notification, Lahore High Court’s decision of May 29, and notification of June 12 are suspended until a future date. After the oath-taking of Chief Justice Lahore High Court, meaningful consultation will be conducted as soon as possible, and a hearing will be scheduled for the case.
