Supreme Court Dismisses Petition on Judges’ Transfers, Justice Musarrat Hilali Comments on Judges’ Desire to Serve in Big Cities
Islamabad: The Supreme Court’s five-member bench, led by Justice Amin-ud-Din Khan, dismissed a petition related to the transfer and posting of judges after the petitioner withdrew the case. During the hearing, Justice Musarrat Hilali remarked that “every judge desires to serve in a major city.”
The petition, filed by Mehmood Daoud, had raised concerns about the frequent transfers of Chief Justices of the Lahore High Court. Daoud claimed that in one year, three different Chief Justices were appointed, leading to multiple transfers and postings of judges. He argued that while the High Court is independent, a clear policy on transfers and postings was necessary.
Justice Jamal Khan Mandokhel emphasized that the policy regarding judges’ transfers and postings falls under the purview of the High Court, and the Supreme Court should refrain from intervening in administrative matters. He also noted that the High Court is free to manage its affairs.
Justice Musarrat Hilali added that it is within the discretion of each Chief Justice to make decisions regarding transfers, and questioned why administrative matters were being brought to the court. “Every judge wants to serve in a major city,” she remarked.
As the petition was withdrawn, Justice Amin-ud-Din Khan concluded the proceedings, stating that the court would not entertain the request. The petitioner, Mehmood Daoud, requested permission to approach the High Court, which was not granted. The case was dismissed accordingly.
