Justice Ayesha Malik Withdraws from Hearing Customs Act Case in Constitutional Bench

Islamabad:Justice Ayesha Malik has issued a written note stating her refusal to hear the Customs Act case in the Constitutional Bench. She explained that due to the ongoing proceedings and the sanctity of the case, she cannot be part of the Constitutional Bench.

Justice Malik pointed out that there is an existing order from a three-member bench dated January 16, which directed the case to be listed. However, despite this order, the judicial committees withdrew the case from the bench, disregarding the court’s directive. She emphasized that judicial orders cannot be overruled by administrative commands and must always be respected within the courtroom.

Justice Malik further clarified that she had already heard the case in a three-member regular bench, and as per her respect for judicial traditions, she would not participate in this matter in the Constitutional Bench.
