Justice Ayesha Malik Recuses Herself from Constitutional Bench Hearing in Supreme Court

Islamabad:Justice Ayesha Malik has recused herself from hearing appeals regarding the constitutional status of Section 221-A of the Customs Act, leading to the dissolution of the bench assigned to hear these appeals.*

Justice Malik stated that she could not hear the case and would provide separate reasons for her recusal. The case involved the constitutional interpretation of Section 221-A of the Customs Act, and her withdrawal caused the bench to break up.

Justice Mansoor Ali Shah had previously initiated contempt of court proceedings concerning this matter. Barrister Salahuddin, representing the petitioner, informed the court that there was significant controversy surrounding the case and that a previous order had been issued. He requested that the case be heard promptly.

In response to Barrister Salahuddin’s request, the head of the constitutional bench, Justice Aminuddin Khan, decided to adjourn the case until tomorrow.
