Justice Afsal Mujoka’s Remarks Stir Controversy During Appeal Hearings

Islamabad: During the central appeal hearings against the penalty for contempt of court during the waiting period of marriage in the case of PTI founder and Bushra Bibi, Additional District and Sessions Judge Muhammad Afsal Mujoka made remarks invoking Hanafi jurisprudence, stating that according to it, if divorce has occurred, the case of waiting period does not arise.
The proceedings, overseen by Islamabad High Court, witnessed objections raised by Khawar Maneka’s counsel against judicial decisions made during the trial court. Barrister Salman Akram Raja also brought forward objections during the trial regarding judgments related to inheritance rights of women after the death of their second husbands.
Advocate Khawar Maneka referenced former US President Bill Clinton during the hearings, while emphasizing on legal points in defense against objections raised by PTI’s legal team. The proceedings faced challenges in the appellate jurisdiction, which were countered by objections filed in both Islamabad High Court and Session Court.
After a brief recess in the hearings, Khawar Maneka’s counsel expressed intent to complete the presentation of evidence today, aiming to substantiate their claims. Meanwhile, Justice Afsal Mujoka clarified procedural rules regarding witness testimonies during cross-examination, asserting that questions must pertain strictly to statements recorded by the police.
The court adjourned the case until 8 PM for further proceedings on the prosecution’s evidence, ensuring a comprehensive review of documents and oral arguments tomorrow.
