Islamabad High Court Directs to Refile Petition on D-Chowk Protest Within Seven Days
Islamabad: The Islamabad High Court (IHC) has directed the petitioner to address objections and refile the petition regarding the post-D-Chowk protest campaign against state institutions within seven days. The court also stated that the President and Prime Minister cannot be summoned personally based solely on newspaper clippings.
The petition, filed by Advocate Talib Hussain, was heard by Chief Justice Aamir Farooq, who raised several concerns during the proceedings. The lawyer had originally included the President, Prime Minister, and other government ministers in the petition, seeking to summon them in person over their alleged involvement in the November 26 protest incident.
In response to the lawyer’s arguments, Chief Justice Aamir Farooq questioned the basis of the petition, particularly the demand to summon top officials personally. The lawyer cited newspaper reports as evidence of the ministers’ involvement. However, the Chief Justice remarked that the court cannot rely on newspaper clippings alone to summon individuals. He emphasized that investigations into such matters are the responsibility of relevant state institutions, not the court.
The Chief Justice instructed the petitioner to revise the petition and ensure it is properly formulated, adhering to legal standards, before it is refiled. The court also set a deadline of seven days for the re-submission of the petition.
