Sindh High Court Grants Further Relief to K-Electric CEO

Karachi: The Sindh High Court has granted further relief to K-Electric CEO Munees Alvi by extending the stay order on his removal from office until September 12. The decision was made during the hearing of an appeal against the Provincial Ombudsman’s order to remove Alvi from his position.
A two-member bench, led by Justice Mohammad Iqbal Kalhoro, heard the case in which Munees Alvi, accompanied by his lawyer Barrister Abid Zuberi, challenged the decision. Both the Provincial Ombudsman and the opposing party, represented by a woman, submitted written responses to the court.
The representative of the Provincial Ombudsman argued that Alvi’s petition was inadmissible and should be dismissed, stating that the matter regarding the Ombudsman’s jurisdiction was currently pending before the Supreme Court. Hence, the Sindh High Court was not authorized to hear the case.
The court directed Alvi’s lawyer to submit a rejoinder and extended the stay order until September 12, allowing Alvi to retain his position temporarily. Barrister Abid Zuberi informed the court that Alvi had already filed an appeal against the Provincial Ombudsman’s decision with the Governor of Sindh.
Justice Kalhoro remarked that since the petitioner already had a stay order, the court questioned what further action was sought. He further inquired about the Governor’s decision on the appeal. The woman’s lawyer responded that the Governor had rejected the appeal, but Barrister Zuberi clarified that the Governor had not yet dismissed the appeal, and a hearing had been scheduled for Monday.
Justice Kalhoro emphasized that under the law, the petitioner had the right to appeal, and as long as the appeal was pending, how could Alvi be removed from his position? He suggested that the case be pursued before the Governor since the appeal was under consideration.
The Provincial Ombudsman had previously ordered the removal of Munees Alvi due to allegations of harassment against a woman.
