Former PCB Chairman, Naseem Zehra Among More Residents Challenging One Constitution Avenue Verdict

Islamabad:More residents of One Constitution Avenue have filed an intra-court appeal in the Islamabad High Court against the single bench verdict issued on April 30.

The appeal was submitted by Ehsan Mani, Naseem Zehra, and Maira Faisal.

According to the petitioners, they are lawful sub-lessees and occupants of apartments in the One Constitution Avenue project.

The intra-court appeal stated that the Supreme Court of Pakistan, in its January 9, 2019 order, had distinguished the land occupied by the towers from other undeveloped land.

The appellants argued that lease payments for the construction of Towers B and C had already been made and that the towers could not be confiscated by the state in place of any alleged default by BNP.

The appeal further stated that the Capital Development Authority had acknowledged the status of sub-lessees after taking over the administration of the towers following the cancellation of the lease.

The petitioners requested the court to declare paragraph 30 of the single bench verdict null and void, arguing that it contradicts the Supreme Court’s earlier orders.

They also urged the court to recognize their leasehold rights as lawful and restrain the CDA from interfering in their peaceful possession of the apartments.
