Sindh High Court Orders Handover of Delhi Government School to Old Boys Association

KARACHI: The Sindh High Court has ordered that possession of the Delhi Government School be handed over to the Old Boys Association, while allowing a petition seeking the vacation of the school premises.

The court had issued a decree in favour of the Delhi Anglo-Arabic College and School Boys Association in 2000. However, despite the court’s decree, the decision could not be implemented for the past 25 years, said Barrister Asad Ahmed, counsel for the decree-holder.

The government counsel requested additional time to shift the students to other schools and facilitate implementation of the court’s order. However, the association’s counsel opposed the request, arguing that the premises had been taken over again in 2007 despite earlier proceedings.

Barrister Asad Ahmed said the Sindh High Court had ordered in 2009 that the students be shifted to other schools within 15 days. Counsel for the Old Boys Association said it was regrettable that the court’s decision had still not been implemented despite more than 15 years having passed.

After reviewing the lengthy litigation and the history of the case, the Sindh High Court issued a final order directing that the school building be handed over to the Old Boys Association.
